EMERGENCY ORDER! SUPREME COURT SIDES WITH VOTERS IN FIGHT AGAINST CHALLENGING ELECTIONS

In the lawsuit, Black leaders claimed that the Republican-controlled General Assembly approved a redistricting plan that dilutes the Black vote in two of the five PSC districts.

Georgia’s Public Service Commission elections were postponed earlier this month by a judge, who ruled that the electoral system disenfranchises Black voters. The state appealed that first ruling one week later, and an appeals court reversed it.

As a result, the Supreme Court has ruled that elections cannot proceed while the appeal is pending.

Nico Martinez, a partner at Bartlit Beck LLP who represented the challengers, said the Supreme Court’s decision is an “important step toward ensuring that this November’s PSC elections are not held using a method that unlawfully dilutes the votes of millions of Black citizens in Georgia.”

“We look forward to presenting the merits of our case on appeal and are confident the district court’s well-reasoned decision will ultimately be upheld,” Martinez said in a statement.

Furthermore, the Conservative Brief notes that the Supreme Court’s order comes as many states battle over new congressional maps before key elections in 2022 and 2024.
