As a result of the possibility of a Republican House, President Joe Biden retracted his promise to codify Roe v. Wade as his first piece of legislation after the midterm elections.

In the event that Democrats gain control of the House and the Senate, Biden has previously said that codifying the federal right to abortion would be his top priority.

Roe was overturned by the Supreme Court in June, leaving abortion up to the states.

“I don’t think there’s enough votes to codify, unless something happens unusual in the House,” Biden told reporters on Monday.

Biden’s prediction about Democrats losing the House was echoed by CNN Monday as well.

During “CNN This Morning,” CNN’s senior data reporter Harry Enten said it would be hard for Democrats to make a comeback in the House after they retained control of the Senate.
