Republican Lawmakers Eagerly Waiting To Impeach DHS Chief

The Department of Homeland Security is in shambles and the Republicans in Congress are looking forward to next year so they can hold Alejandro Mayorkas accountable. They are well aware he is not the sole issue as to why the border is a disaster, but he is not helping the situation. 

Twenty Republicans on Tuesday demanded that the House move to impeach Homeland Security Secretary Alejandro Mayorkas in the next Congress. This is another sign that border issues will play a major part of the Republican oversight agenda next year.

Congressman Andy Biggs introduced articles of impeachment against DHS Chief Alenjro Mayorkas back in August. Here is what he had to say.

In spite of these renewed calls for Mayorkas’ removal, impeachment is a longshot.

Impeachment requires the House to pass a resolution presenting its case for whatever crime or misconduct was committed. This resolution can pass with a simple majority vote. When the House votes, the Senate sits on trial under the supervision of the chief justice of the Supreme Court.

Afterwards, the Senate votes on whether to convict or acquit the individual. It takes two-thirds of the Senate, 67 votes if all are present, to convict. It will be impossible to convict Mayorkas or anyone else in the Senate without the help of 18 Democrats next year.

One of the most affected states (Texas) has pleaded for almost two years for this administration to change their dangerous policies that it has rightfully taken matters into its own hands.

The Hill Reported, Texas Gov. Greg Abbott claims that President Biden’s failure to faithfully execute the immigration laws enacted by Congress has violated Article IV, § 4 of the U.S. Constitution, which provides that “[t]he United States . . . shall protect each [State in this Union] against Invasion.”  

The border crisis hit a new record in May 2022, which saw the largest number of illegal border crossers along our southern border since CBP began keeping track in 2000, and these unprecedented numbers are overwhelming local communities across Texas.

As a result, Abbott has decided to use its authority under Article I, paragraph 10 of the Constitution to protect itself against an “invasion” of undocumented migrants at the Southwest border.

Clause 3 of Article 1 § 10 states: “No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.”

A Supreme Court ruling held in the mid-1800s that the phrases “unless actually invaded” and “in such immediate danger” refer to invasion or the threat of an invasion by a foreign power, “indians,” or pirates.

If the federal government is putting individual states in harm’s way, they should be allowed to protect themselves.

Alejandro Mayorkas has been a complete failure when it comes to the border crisis. He behaves as if he’s supposed to put on a show and tell us everything is okay, even though anyone who takes a look at the situation can see that it isn’t. People all over this nation are demanding more, yet Mayorkas continues to come up short. On top of that, he only follows orders given to him by the administration and never attempts to have any real input in resolving the issue. It’s obvious that no progress is being made under his command and it’s time we relieve him of his duties so Americans can stop holding their breath waiting for nothing to happen.
