According to a CNN guest Tuesday, by preserving Title 42, the Supreme Court “saved Joe Biden from himself” when it came to the border.

Scott Jennings, a former senior adviser to Republican Sen. Mitch McConnell, told CNN that it was a “big political win” for more than a dozen Republican attorneys general, led by Mark Landry of Louisiana and Mark Brnovich of Arizona, who challenged the ruling of United States District Judge Emmet Sullivan that would have ended Title 42 on Dec. 21.

According to the 5-4 ruling cited by the Daily Wire, the Supreme Court left Title 42 in place pending arguments in February. Title 42 is the Trump administration’s public-health measure for expulsion of illegal immigrants. Justices Ketanji Brown Jackson, Neil Gorsuch, Sonya Sotomayor, and Elena Kagan dissented from the decision.

Over 2.3 million migrants were encountered by the Customs and Border Patrol (CBP) in Fiscal Year 2022, and another 230,000 in October, the first month of the fiscal year, according to official figures, while another 600,000 eluded CBP. According to a Friday release, CBP encountered 233,470 people in November.

In the wake of Title 42 ending, Customs and Border Protection officials warned lawmakers that approximately 50,000 foreigners were waiting to cross into the country.

In response to a Supreme Court order, the White House promised to keep Title 42 in place, but blamed congressional Republicans for chaos on the southern border, where thousands of migrants have gathered to await the ruling.

On Tuesday, Biden’s press secretary Karine Jean Pierre released a statement that reads in part, “Title 42 is a public health measure, not an immigration enforcement measure, and it should not be extended indefinitely. To truly fix our broken immigration system, we need Congress to pass comprehensive immigration reform measures like the ones President Biden proposed on his first day in office.”

The Supreme Court’s decision to leave Title 42 in place pending arguments in February is just a temporary response to chaos on the southern border. Migrants have gathered in mass numbers, prompting Customs and Border Protection officials to express notifications of their presence. The Biden administration has been shamed for causing the chaos and endangering national security with their lack of forethought, leading many to speculate that they must not have some sort of replacement plan when Title 42 comes to its official end. It’s important now more than ever that they act swiftly, as chaos on the border opens up potential risks that can only be averted through strict border regulations.
