A Federal Appeals Court Recently Ruled Against an ATF Gun Law

This recent ruling by the Federal Appeals Court is a much-needed victory for Second Amendment advocates. It serves as confirmation that the rights of gun owners are still being respected and that limits on these freedoms will not be accepted without a fight. The decision is seen as a rallying point for those wanting to keep their firearms and use them as they were meant to be used, free from bureaucratic interference and government overreach.

The Founding Fathers created a system of checks and balances, designed to ensure individual rights would not be overstepped. Happily, the Federal Appeals Court has done its part by recently ruling against the ATF in their attempt to impose a bump stock ban. The result is that legislative authority has been firmly placed where it was intended – within Congress and them alone. This ruling is met with great relief by 2A advocates who understand that our right to bear arms must be protected by even the strictest interpretation of our Constitution. At the very least, this situation demonstrates that those wishing to uphold individuals’ fundamental rights still have something to fight for!

Daily Wire Reports, On Friday, a federal appeals court overturned a ban on bump stocks put in place after the 2017 Las Vegas shooting by the Trump administration. 

New Orleans’ 5th Circuit Court of Appeals overturned the ban in a 13-3 decision on Friday, stating the Federal Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) overstepped its authority. 

In 2018, President Donald Trump requested that the ATF enforce existing federal laws against bump stocks, reinterpreting “single function of the trigger” and “automatically.” As a result, guns with bump stocks were categorized as machine guns, making them illegal under federal law.

So what is a bump stock, what does it actually do, and why did the ATF go after them?

In the case of Rich Samp, the attorney for the man who sued the government after his bump stocks were forced to be removed. This discussion was about who sets gun laws, not gun control.

In light of the 5th Circuit’s decision, a Supreme Court showdown could be looming for the future of the regulation. This is because the regulation has not yet been struck down by other circuit courts.

As a group that has also sued to overturn the ban, Gun Owners of America praised the court’s decision, saying it was crucial to defending the Second Amendment.
