Biden’s Student Debt Forgiveness: A Battle Against the Supreme Court?

The Biden administration is pushing for student debt forgiveness, despite a Supreme Court ruling against it. Education Secretary Miguel Cardona recently stated that the Supreme Court “got it wrong” in its decision to strike down President Biden’s $430 billion student debt relief policy. The Supreme Court ruled that the HEROES Act of 2003 does not give Biden the authority to cancel billions in student loan debt. Despite this, the administration is approving applications for millions of borrowers, raising concerns about the administration’s respect for the law and the financial implications for taxpayers. In response, the administration has outlined three alternative debt relief actions and protections for borrowers from the “worst consequences” of late or partial payments. Critics argue these measures reward irresponsible debt management.
