The trial involving Michael Sussman, Hillary Clinton’s campaign lawyer, ended Tuesday after the jury found him not guilty. Sussman was being charged in Special Counsel John Durham’s investigation for lying to the FBI.
The charge centered around Sussman allegedly telling bureau general counsel James Baker that he was not working on behalf of Hillary Clinton campaign. To clarify, Sussman was the one that turned over the falsified secret communications between the Trump organization and Russia.
Judge Napolitano on a Youtube channel, Judging Freedom, posted his thoughts on the verdict.
According to Durham, Sussman was working on behalf of the Clinton campaign, when he talked to Baker and gave him evidence on jump drives showing allegations of collusion between Trump org and Russia’s Alfa bank – which has been alleged to be tied to the Kremlin.
Durham responded to the jury verdict, “While we are disappointed in the outcome, we respect the jury’s decision and thank them for their service. I also want to recognize and thank the investigators and the prosecution team for their dedicated efforts in seeking truth and justice in this case.”
The closing arguments took place on Friday before Memorial weekend. The jury asked for several trial exhibits and then resumed deliberations Tuesday before making their verdict. In total, the trial lasted 11 days and was presided over by Judge Christopher Cooper for the U.S. District Court for the District of Columbia.

Durham said that the material Sussman gave to the FBI was “opposition research” and was meant to hurt the Trump campaign in an “October Surprise” right before the 2016 election. Durham’s team also alleged that Sussman billed Hillary’s campaign for the time he spent on the FBI meeting.
Durham worked for over three years to make his case and did not respond to questions after the jury spoke, but he has started to attract some critics online.
The FBI found no evidence of former President Trump being involved with the Russian government, but said that they would have investigated the Trump-Russia case presented to them by Sussman regardless.
Sussman’s attorneys argued that he was working with the Clinton campaign and as a private citizen brought the information he saw to the FBI.
Durham was appointed by former Attorney General Bill Barr as special counsel in October 19, 2020.
