Rep. Robert Garcia (D-CA), the top Democrat on the House Oversight Committee, is already drawing up his subpoena list — and he's not waiting for the votes to be counted to talk about it.

In an interview with The Hill, Garcia said that acting Attorney General Todd Blanche and other Trump administration officials would likely face subpoenas on "day one" if Democrats flip the House in Tuesday's midterm elections. A Democrat majority would hand Garcia the committee gavel and its subpoena power. The Trump family, immigration enforcement, and the Epstein files would follow, according to Breitbart's coverage of the remarks.

The Long Beach Democrat argued his party needed new rules and a new standard to counter a president he accused of trying to rig elections. His team, he has said, is already preparing probes into "Trump family corruption" and the Epstein files.

The preview drew an immediate warning from House Judiciary Committee Chairman Jim Jordan (R-OH), who said a Democrat House would launch "nonstop investigations." The targets, he said, would be the first family and the next Republican presidential nominee. The investigations would hand Democrats a two-year license over oversight if they win either chamber.

Semafor reported that the Democrat Party's base is now driven more by a hunger for vengeance than by any interest in moving past the Trump era. Writer Dave Weigel noted no Democrat with a gavel would want to abandon Trump oversight.

The subpoena talk lands amid an already heated fight over election administration. At Trump's direction, the Justice Department sued to block certification of Alaska's Senate race should Republican Senator Dan Sullivan (R-AK) lose to Democrat Mary Peltola, after a New York Times report that Peltola-aligned operatives recruited a second candidate also named Dan Sullivan. U.S. District Judge Sharon Gleason, an appointee of former President Barack Obama, dismissed that suit Sunday, ruling the relief sought was "infeasible" because many ballots had already been cast. Peltola's campaign said no "weaponized" Justice Department would stop Alaskans from voting, and the department said it would appeal.

Garcia's committee has been busy in the minority, too. On Tuesday, his office demanded answers from Secretary of State Marco Rubio after the Trump administration allegedly helped bring Flávio Bolsonaro, a Brazilian politician under investigation for money laundering and corruption, into the United States. "Donald Trump appears to have no problem pulling out all the stops for a far-right Brazilian politician who lost his election and is under investigation for corruption," Garcia said in a statement. "Secretary Rubio should send Bolsonaro home to face justice and fully explain why this Administration helped bring him here."

Garcia has also pressed Rubio and Blanche over an alleged scheme to take an ownership stake in a Venezuelan oil company, and over a reported 2025 deal with Salvadoran President Nayib Bukele that resulted in the release of MS-13 leaders back to El Salvador.

A verified Instagram post from the congressman's account promotes the Oversight Committee's work, captioning the reel, "Congressman Robert Garcia | The Oversight Committee is at ..." The post does not detail the subpoena plans discussed with The Hill.

If Democrats take the House, Republicans would lose their ability to pass legislation through that chamber without Democratic support. A Democratic majority could launch investigations into the administration, demand documents and testimony, and subject senior officials to sustained congressional scrutiny, according to The Guardian's preview of the midterms. Democrats might also come under pressure from their support base to impeach Trump for a third time, the outlet reported. In the Senate, a Democratic majority could block or delay many of Trump's appointments and force the White House to negotiate over legislation.

Even if Republicans retain one or both chambers, a reduced majority could make governing more difficult, particularly when legislation requires near-unanimous support from the party's own members, The Guardian noted.

What remains unknown is whether Garcia would follow through on the "day one" timeline, and precisely which officials beyond Blanche would be called first. It is also not yet known whether House Democrat leadership has signed off on the sequencing Garcia described.

Our Take

Here's what Garcia is really telling voters three days before an election: give us the gavel and we'll spend two years subpoenaing your government instead of fixing anything. Not the border. Not inflation. Not the cost of heating your home this winter. Todd Blanche's testimony calendar.

This is the same playbook Democrats ran in 2018 — and they got shellacked for it. Jim Jordan is right that a Democrat House means "nonstop investigations," but it's worse than that. It means a two-year license to grandstand while the country waits. And the Epstein file push is rich coming from the party that sat on what it had when it controlled the chamber.

Patriots, Tuesday is the whole ballgame. The only thing standing between Robert Garcia and a subpoena pen is your ballot. If you think the Trump family, ICE agents doing their jobs, and the President's advisers deserve to be dragged into a Democrat circus, stay home. If not — vote like it.

This is exactly why we need to flip the House back - the subpoena merry-go-round has to stop. Garcia is basically admitting day one is going to be pure political theater instead of actually governing.

Funny how the party that screams about weaponization is already announcing their weaponization plan.

Spot on. They spent two years investigating instead of legislating, and now they're already promising round two before they've even won.

I lived through the last round of these hearings - my husband and I watched every minute. What did we get? A bunch of soundbites and zero results, so excuse me if I'm not impressed by Garcia's 'day one' threats.
