Carlson, the current deputy administrator of the National Highway Traffic Safety Administration, previously worked at the University of California, Los Angeles School of Law dealing with environmental policies. The Republicans on the Senate Commerce Committee have raised concerns over Carlson’s policies, citing the rise in EV mandates across the country. They claim that these rules would violate the Supreme Court case West Virginia v. EPA and would cause “vast economic and political significance” requiring “clear congressional authorization.” The lawmakers mentioned California’s ban on gas-powered vehicles by 2035, which creates a path for other states to follow suit. This, coupled with the new environmental standards advanced by the Environmental Protection Agency, has led Republicans to battle Biden’s green agenda.

The letter reads “Based on your record, we are deeply concerned that the NHTSA will follow the EPA’s lead and propose similarly radical vehicle fuel economy standards that run contrary to the law, diminish vehicle choice, impose higher costs on American families, and undermine our national and energy security all while benefiting China,” 

This pushback from Republicans comes after multiple Biden nominees have received criticism over their qualifications, including Gigi Sohn and Phillip Washington. Sohn, Biden’s pick to serve on the Federal Communications Commission, withdrew her nomination in March after a long battle with Republicans who believed she was too radical. Phillip Washington, the president’s choice to head the Federal Aviation Administration, also withdrew his nomination at the end of March after Republicans took aim at his level of experience.

Julie Su, nominated to head the Department of Labor, is also under fire, encountering opposition from the Senate and small business groups, citing her record while leading California’s labor department.
